1. Agreement to Terms

By accessing or using SkillFront Academy ("Service") provided by Kuton Labs Ltd ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

SkillFront Academy is a learning platform that provides skill assessments, personalized learning paths, and educational content. The Service includes both free and paid features.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information
  • Promptly updating your account information

You must be at least 16 years old to create an account. If you are under 18, you represent that you have parental or guardian consent.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any laws
  • Transmit any harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Copy, reproduce, or distribute our content without authorization
  • Create accounts through automated means or under false pretenses
  • Share assessment answers or attempt to circumvent assessments

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Kuton Labs Ltd and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content as necessary to provide the Service.

6. Payment Terms

Paid subscriptions are billed in advance on a recurring basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

We may change our fees at any time. For existing subscribers, price changes will take effect at the start of the next billing cycle after at least 30 days' notice.

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may discontinue using the Service.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

In no event shall Kuton Labs Ltd, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses, resulting from your use of the Service.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability for consequential damages, our liability shall be limited to the maximum extent permitted by law.

Our total liability to you for all claims arising out of or relating to the use of the Service shall not exceed the amount paid by you to us in the twelve months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Kuton Labs Ltd and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney's fees).

12. Governing Law

These Terms shall be interpreted and governed by the laws of England and Wales, without regard to conflict of law provisions. Any legal disputes shall be resolved in the courts of England and Wales.

For users in the European Union, nothing in these Terms affects your rights as a consumer under EU consumer protection laws.

For users in the United States, you may also have rights under state consumer protection laws.

13. Dispute Resolution

We encourage you to contact us first to resolve any disputes. For users in the EU, you may also use the European Commission's Online Dispute Resolution platform.

If you are a consumer residing in the EU, EEA, or UK, you have the right to pursue disputes through your local consumer protection authorities or courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on the Service and updating the "last updated" date.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and Kuton Labs Ltd regarding the use of the Service, superseding any prior agreements between you and us relating to the Service.
